As has been the case from time to time, the topic of conversation turned to the subject of forecosures by (Mortgage Electronic Registration Systems) and the large number of foreclosures perpetrated by MERS in Oklahoma and all other states. Mers attempts to stand in the stead of the true lender or investor in order to help them facilitate the foreclosure of property and the evasion of taxes by having them foreclose on property. They use an enormous variety of tricks and subterfuge in order to make the courts believe that they are the injured party when in fact they are not.

T. J. Acton wins in Oklahoma County Court today.

Student T.J. Acton of Oklahoma City stopped MERS cold in Oklahoma
County Court today.

He will have a hearing in February to vacate the void judgment. We
have every reason to believe that he will win on that one too.

In another similiar situation with Bill Worden, the attorney for the
plaintiff claimed that his plaintiff absolutely had standing to sue in
Oklahoma Courts under Title 18 of the Oklahoma Statutes.

We have proved that the attorney has testified in making that
statement and that the statements did not originate from the Plaintiff
and is in fact in direct contradiction with what the Plaintiff has
publicly stated. We now allege that the attorney provided false and
misleading information to the court and have stated that providing
false and misleading information to an Oklahoma Court is a felony
offense of sufficient magnitude as to shock the sensibilities of the
court and that he should be sanctioned in an amount of money
sufficient to amend his bad behavior.

We are not making that as a motion but rather only as a suggestion to
the court. We will see how that turns out. But we do have proof
positive that the attorney improperly provided testimony to the court
which sas improper for him to do but also that his testimony was false
and fraudulent.

Should be fun.

T.J. will relate the rest of the story about how a well known Oklahoma City attorney followed him out of the courtroom and told him that in over 30 years of law practice he had never seen a final foreclosure action stopped cold like that. He wanted to know how T.J. came to know how to do that. T.J. told him that it was just common knowledge and went on home.

Needless to say, although there is still a lot of courtroom activity to come in February and beyond T.J. is a mighty happy man today.

Although he should have no problems getting the judgment and foreclosure stopped and vacated as being null and void upon its face, he knows that someone will file a new case on him someday i the future but he will be giving them a whole bunch of new headaches very quickly. If they ever do actually get his home it will be many, many years down the road.

Why we were down yesterday

We were unable to answer any emails sent to us yesterday afternoon or evening because we were not on line due to the installation of a new UPS backup system. The old one which I had bought as a used surplus unit several years ago finally gave up the ghost.

I had known for a long time that the old unit was bad but just put off buying a new one because of the cost of the beast and the difficulty of installing it. Obviously I’m not talking about something you buy at Wal-Mart or even Compusa. I’ve got some of those too. Even keep one on my 100 gallon fishtank which only has one huge fish in it.

Even though we spent 2 days getting ready for the installation we were still down well over 8 hours yesterday evening getting it installed.

We didn’t lose any emails in the process but it sure did put a hitch in the git-along for a few hours, but partly because we also did a thorough cleaning job and servicing on 6 of our computers while we were down.

Creditwrench Student Paul Kline wins in court against Citibank who had sued him in his local court. These audio recordings of students announcing their wins in court prove that Creditwrench methods really do work. Many websites use testimonials from people who have used their products or services and are happy with the results but those testimonials are always printed testimonials and one never knows whether they are real people or just fictitious names picked out of a telephone book or what. Even photos don’t prove a thing because they could have been taken anywhere and might be of anyone but when you hear the actual voices of people telling their stories in their own words then you know for sure that they are real people.

Creditwrench messge board is down.

Many of you might be wondering why the Creditwrench Message board is down.

The reason is that it is growing so fast that we have run out of space on our old 4 gigabyte server and had to be moved to a much larger server in order for it to continue to grow. The move required that a different I.P. address be assigned to the new server and then all of the links repaired to make them point to the new server. This is a rather time consuming process and may take a couple of days or so.

The move also affected our email address but we got that cured rather quickly. The move is also the reason why our podcasts for last Friday evenings conference call has not yet been posted.

Please bear with us while we move to larger quarters.

Podcasting the Creditwrench Conference call

Below are the mp3 recordings of the Creditwrench conference call for January 6th, 2006.

Each segment is half an hour long. The conference calls are gaining popularity and listeners rapidly. I’m noticing that most of those who are actually doing the talking are Creditwrench students who have actually won in court and some of them have won multiple times.

One such student is Bill Worden. Bill came to me late last Wednesday evening and related the story of how he had just found out that a home he owns had been foreclosed on and sold at a sheriff’s sale and they were going to hold a final confirmation hearing on the sale last Friday. He asked me if there was anything that could be done to save his property. We met at a local restaurant where I looked over the paperwork and told him that I thought I might be able to help him. By Friday morning he had his paper work all ready to file and he did just that and then went to the hearing along with his wife. Each of them had reasonably separate documents and evidence to support their objection to the final confirmation of the sale. They didn’t have time to prepare motion to vacate the void judgment and the judge asked them why they hadn’t done that and Mrs. Worden replied that they simply didn’t have time so the judge gave them until the 26th of January to do that.

Here is what Bill had to say about it when he called me to relay the good news of what had happened to him in court.

Bill and his wife each filed an objection to the confirmation of the sale and now they will move forward with motions to vacate and other things which should get them not only their house but a nice fat sum of cash besides that.

Can you win using the same arguments? Well, maybe yes and maybe not. That depends on who it was that tried to foreclose on your home or sue you because of some other reason. But you will never know until you try!
